On the evening of April 23, 2023, Chen Hongbing, professor and doctoral supervisor of Southeast University School of Law, was invited to give a lecture on Methods of Criminal Law Interpretation to students at Northwestern University of Political Science and Law (Yanta Campus) in the Academic Lecture Hall on the second floor of the Graduate Student Complex. The lecture was hosted by Prof. Fu Yuming, PhD supervisor of the School of Criminal Law of Northwest University of Political Science and Law, director of the Research Center for Criminal Law Studies and director of the Institute of Corporate Compliance. Professor Feng Weiguo, Associate Professor Ran Juhuo, Dr. Zou Fan, Dr. Yang Zhibo and Dr. Yang Yuhao, Dean of the School of Criminal Law of Northwestern University of Political Science and Law, were the panelists. Some leaders from Shaanxi Province Federation of Industry and Commerce, Guangxi Province Federation of Industry and Commerce, as well as some teachers and graduate students from Northwest University of Political Science and Law attended the lecture.
At the beginning of the lecture, Prof. Fu Yuming expressed his warm welcome and thanks to Prof. Chen Hongbing, and introduced the basic information of Prof. Chen Hongbing to the students, and made a brief introduction to Prof. Chen's academic research and academic achievements.
During the two-and-a-half-hour long lecture, Prof. Chen Hongbing focused on the theme of the method of interpretation of criminal law sub-clauses, took a dozen of criminal law issues with both theoretical and practical values as the thread, combined with typical cases, flexibly used the method of criminal law interpretation, and gave an in-depth explanation of the interpretation and application of specific criminal provisions, and put forward many unique ideas. Professor Chen Hongbing suggests that the reason why purpose of unlawful possession is required to establish the crime of theft is to distinguish it from the crime of intentional destruction of property and non-punishable theft, which does not have the intention of exclusion and exploitation, while the crimes of logging and theft of firearms do not require such a distinction, and there is no need to attach the unwritten element of purpose of unlawful possession; as to whether the same kind of several crimes should in principle be punished together, Professor Chen Hongbing believes that the criteria for judging whether they should be Therefore, for several crimes of the same kind, in principle, they should be punished together, and only when they can still achieve the compatibility of crime and punishment through concurrent punishment, exceptionally, they should not be punished together. In addition, Prof. Chen Hongbing also pointed out that judicial interpretation is an open rather than a closed interpretation, and judicial interpretation can only clarify the application of criminal law provisions through enumeration and example, but does not have the power to make laws.
In the discussion session, all teachers praised the passion and charm of Mr. Chen's lecture. Associate Professor Ran Juhuo expressed his admiration and praise for Professor Chen Hongbing's academic style and research, and welcomed Mr. Chen to give lectures at Northwest University of Political Science and Law frequently. Dr. Zou Fan talked about the teaching methodology from Prof. Chen Hongbing's teaching style, and said that Mr. Chen's lectures have inspired him in terms of research direction, research depth and teaching methods. Dr. Yang Zhibo said that the lecture showed that Mr. Chen's grasp of criminal law sub-rules is both broad and precise, and said that as a young teacher, he should learn from Mr. Chen, strengthen the combination of theory and practice, and really be able to understand the practical problems, and at the same time, he exchanged academic views on the great competition theory and fuzzy guilt theory proposed by Mr. Chen. Dr. Yang said that as a young teacher, he should pay more attention to the study of criminal law, and he hoped that the students would not only gain knowledge, but also learn to question and think, and pay attention to the study of criminal law articles.
