Inaugural Meeting of the Southeast University Foreign Rule of Law Research Centre and Forum on Cultivating Foreign Rule of Law Talents Successfully Held

On the afternoon of 12 April 2024, the inaugural meeting of the Research Centre for Foreign-related Rule of Law of Southeast University and the Forum on Cultivation of Foreign-related Rule of Law Talents were held in the Lidong Lecture Hall of Sipailou Campus of Southeast University. The meeting invited representatives from Jiangsu Higher People's Court, Nanjing Intermediate People's Court, Nanjing Maritime Court, Nanjing Jiangbei New District People's Court, Jiangsu Provincial Council for the Promotion of Trade, Nanjing Lawyers Association, Renmin University of China, China University of Political Science and Law, Fudan University, Shanghai University, Nanjing University, Nanjing Normal University, Nanjing University of Aeronautics and Astronautics, Nanjing University of Science and Technology, Hohai University, Nanjing University of Auditing, Nanjing Forestry University, Nanjing University of Information Engineering, Nanjing University of Technology, Nanjing University of Finance and Economics, as well as experts and scholars in the field of foreign-related rule of law construction from WKG. Liu Qichuan, Secretary of the Law School of Southeast University, Ouyang Benqi, Dean of the Law School of Southeast University, Xiong Zhanglin and Shan Pingji, Vice Dean of the Law School of Southeast University, Xiao Bing, Director of Southeast University Foreign Rule of Law Research Centre, Dai Qingkang, Yu Wentie, Yi Bo and Ye Quan, Associate Professors of the Law School of Southeast University, as well as 20 undergraduates and graduate students of the Law School of Southeast University, participated in the meeting.

At the beginning of the meeting, Liu Qichuan, secretary of Southeast University School of Law, as the host of the meeting, pointed out that the 20th Party Congress put forward a series of new requirements on strengthening legislation in foreign-related fields and integrating the promotion of the domestic rule of law and the rule of law relating to foreign affairs, and that General Secretary Xi Jinping, in presiding over the 10th Collective Learning Session of the Political Bureau of the Central Committee of the Communist Party of China, had made an important speech on the construction of the foreign-related rule of law system and capacity that is compatible with the requirements of high-quality development and high level opening up to the outside world. Strengthening the cultivation of foreign-related rule of law talents, especially the cultivation of high-level foreign-related rule of law talents is the mission of the times for China's legal education and legal practice. Southeast University School of Law based on its own teaching characteristics and talent training needs to set up a foreign-related rule of law research centre, in response to the requirements of the state put forward by the construction of foreign-related rule of law. Secretary Liu Qichuan expressed his thanks to all the experts and scholars for coming and wished the meeting a complete success.

First of all, the meeting was addressed by Professor Ouyang Benqi, Dean of Law School of Southeast University. Dean Ouyang expressed his warm welcome to all the guests and introduced the concept, path and achievements of the cultivation of foreign-related rule of law talents of Southeast University in recent years. He emphasised the objectives and plans of the Foreign Rule of Law Research Centre for talent cultivation, and expressed his expectation for the future cultivation of talents in short supply with an international outlook and proficiency in international and country-specific law.

Afterwards, the conference entered the forum session on cultivation of foreign-related rule of law talents. The first unit of speeches and seminars was hosted by Professor Xiong Zhanglin, Vice Dean of the Law School of Southeast University.

Chen Liang, Vice President of the Fourth Civil Division of Jiangsu Higher People's Court, analysed the quantitative and qualitative needs of foreign judicial talents from the perspective of foreign judicial practice, and pointed out that there are still challenges such as relatively small number of needs, extremely high training requirements and long growth cycle at the level of talent cultivation. Combined with his own rich working experience, President Chen put forward expectations and suggestions on the ability requirements and training mode of foreign-related judicial talents.

President Xia Wenhao of Free Trade Zone Court of Nanjing Jiangbei New District People's Court delivered a speech on ‘Cultivating Comprehensive Foreign-Related Judicial Talents to Meet the Needs of Serving and Guaranteeing the Construction of Free Trade Zone’. Based on the real needs of the construction of FTZ and the actual work of grassroots courts, President Xia proposed that foreign-related judicial personnel need to have both professionalism, comprehensiveness, level of mass work, the ability to find out the facts and other qualities, and further gave suggestions on the cultivation mode and method.

Professor Han Liyu of the School of Law of Renmin University of China made a speech (online) entitled ‘The Return and Transcendence of Foreign-related Legal System’, starting from the concepts of foreign-related rule of law and foreign-related legal system, pointing out that the foreign-related legal system is an important part of the national legal system, which is the foundation of foreign-related rule of law, and further elaborating on the emergence of the foreign-related legal system and the dual-track system, the unification of the domestic legal system, the return and the transcendence of the foreign-related legal system and putting forward concrete suggestions and recommendations for strengthening the capacity of the rule of law in relation to foreign-related legal systems. He also puts forward concrete suggestions and recommendations for strengthening the capacity of foreign-related rule of law.

With the title of ‘Three-dimensional Cultivation Mode of Foreign-Related Rule of Law Talents’, Professor Fang Xiaomin of the Sino-German Institute of Law of Nanjing University and the University of Göttingen introduced the experience and achievements of the Sino-German Institute of Law of Nanjing University and the University of Göttingen in cultivating foreign-related rule of law talents for the past thirty-five years after the establishment of the Institute. Professor Fang introduced in detail the curriculum and cultivation platform of the dual master's degree programme of Sino-German Comparative Legal Studies of the Sino-German Institute, and put forward his outlook on the cultivation of innovative foreign-related legal talents by the Centre for Foreign-related Rule of Law Studies of Southeast University.

Associate Professor Lu Fengyi, Assistant Dean of the School of Law and Politics of Nanjing University of Technology, shared his views on the topic of ‘Cultivating Modern Foreign-Related Rule of Law Talents by Integrating the “Two Big Pictures”’, pointing out the problems of the cultivation of China's foreign-related rule of law talents from the perspective of the country's demand for enhancing international discourse power, and proposing targeted solutions.

Professor Xu Jun from the School of Law and Public Administration of Nanjing University of Information Engineering (NUIE) shared the topic of ‘Borrowing a Boat to Go to Sea: Dilemma and Way Out of Chinese-foreign Cooperative Education in Law Discipline’, introduced NUIE's exploration, innovation and practice of carrying out Chinese-foreign cooperative education in undergraduate education of law, analysed the reality of the dilemma of Chinese-foreign cooperative education in law and put forward the strategy of updating and optimizing the mode of Chinese-foreign cooperative education.

Professor Liu Huiming of the Law School of Hohai University made a speech titled ‘Qualities of Foreign Rule of Law Talents’, arguing that ‘Qualities of Foreign Rule of Law Talents = Cultivation Objectives’ and putting forward five specific requirements, including proficiency in a foreign language, familiarity with the laws or jurisprudence of a foreign country, having read a certain number of foreign legal works or having obtained a foreign law degree, familiarity with a foreign country's law, and the ability to learn a foreign country's law, and the ability to learn a foreign law. law degree, being familiar with the rule of law practice in a foreign country, and having some practical experience in foreign-related legal services.

Zhu Yishu, Associate Professor of Foreign Languages College of Nanjing Forestry University, gave a detailed introduction and analysis of the two modes of cultivation of foreign-related rule of law talents in domestic colleges and universities from the perspective of language teaching under the title of ‘Domestic “Small Language+Law” Foreign-related Rule of Law Talent Cultivation Mode’ and put forward practical suggestions to address the difficulties in the cultivation of language proficiency in the cultivation of foreign-related rule of law talents. Yan Lin, Associate Professor of Law School of Nanjing Normal University, made a speech titled ‘Practice of Cultivating Foreign Rule of Law Talents in Law School of Nanjing Normal University’, sharing the four aspects of distribution of law disciplines, education and teaching reform practice of the disciplines, and practice and reform of cultivation of foreign rule of law talents, sharing the four-year dual bachelor degree cultivation model of ‘Law+English’ of Law School of Nanjing Normal University, which is comparable to that of the United States, Japan and other countries. The cultivation mode of ‘Law + English’ four-year dual bachelor's degree, joint training programmes with universities in the United States, Japan, Russia and other countries, and other foreign talents training methods, which provide learning experience for the cultivation of foreign rule of law talents in Southeast University.

The second unit of speeches and seminars were hosted by Professor Xiao Bing, Director of the Foreign Rule of Law Research Centre of Southeast University and Professor of Law School of Southeast University.

Xie Xinzhu, Deputy Director of the Political Department of Nanjing Maritime Court, shared his profound experience of cultivating foreign-related commercial maritime professionals from the perspective of political cadres in maritime courts. Director Xie stressed that the key to cultivate foreign commercial maritime specialised talents lies in cultivating rule of law self-confidence and judicial wisdom, and called for synergy and innovation among courts, schools and enterprises in the whole process of talent cultivation.

Nanjing Intermediate People's Court International Commercial Court President Yin Yuanyuan's speech to the ‘foreign-related professional trial personnel training practice and demand’ as the title, first of all, the international commercial court staffing, jurisdiction of the type and number of cases, the introduction of the court's human resources and talent cultivation to be briefly introduced, and then expressed two aspects of the demand: First, the theory of training, including foreign-related laws and regulations, the application of conventions and treaties and other aspects; The second is the enhancement of the ability to identify extraterritorial laws, including the search of foreign legal articles and cases, etc. Finally, it expresses the desire to cooperate with universities to effectively enhance the trial capacity of the courts.

Professor Zhang Liying of the School of International Law of China University of Political Science and Law, with the title of ‘The Short Board of Chinese Maritime and Foreign-related Legal Talents Training and the Path to Solve the Problems’, analysed the qualities and current situation of Chinese maritime and foreign-related talents training in combination with his rich domestic and international practical experience, and pointed out the gap of Chinese talents for international legal practice and international organisations. Professor Zhang introduced possible future exchange and cooperation platforms, and put forward constructive suggestions for talent cultivation paths.

Professor Gong Baohua of Fudan University Law School gave a speech titled ‘Cultivation of Foreign Court Jurisprudence Identification and Reading Ability’, pointing out the short board of supply and demand in the cultivation of foreign-related rule of law talents, and then from the meaning of ‘checking and clarifying’, he introduced the method and process of foreign court jurisprudence identification, and put forward the following suggestions for the cultivation of foreign court jurisprudence identification and reading ability After introducing the method and process of foreign court case identification from the meaning of ‘searching and clarifying’, and proposing the four S services of ‘searching, picking, thinking and unlocking’ for foreign court case identification and study ability cultivation, and taking Article 35 of the Montreal Convention as an example, it specifically introduces a practical case of foreign law identification, which will provide a good programme for the resolution of the common problems of foreign law identification in the foreign judicial trial and foreign rule of law talent cultivation.

Professor Sun Wen of Nanjing University-Johns Hopkins University Centre for Chinese and American Cultural Studies shared her views on what international talents are, why we need to cultivate international talents, what qualities international talents need, and how to cultivate international talents. He shared the innovation and practice of Nanjing University-Johns Hopkins University Centre for Chinese and American Cultural Studies in cultivating high-level composite international talents.

Mr Sun Jie from the Law School of Nanjing University of Finance and Economics made a speech entitled ‘International Law Education Based on International Treaty Texts - A Perspective on Cultivation of Foreign Rule of Law Talents’, pointing out that the cultivation of foreign rule of law talents can not be limited to international law education and research, but international law education and research will inevitably become an important part of the cultivation of foreign rule of law talents, and arguing that the teaching and research of international law discipline is an important part of the cultivation of foreign rule of law talents. It is pointed out that the cultivation of foreign-related rule of law talents cannot be limited to international law education and research, but international law education and research will inevitably become an important link in the cultivation of foreign-related rule of law talents, and it is believed that the teaching and research method of the discipline of international law lacks the attention to the text of the international treaties and other norms of international law as well as the platform for the application of the text of the international treaties.

Associate Professor Wu Yiming from the Law School of Nanjing Audit University took the demand for foreign-related talents in the judicial sector as the starting point, shared his experience and experience in training foreign-related judicial talents in colleges and universities, analysed the difficulties involved, and put forward the outlook for the future cooperation between colleges and universities in Nanjing, and cooperation between colleges and universities and the judicial sector.

Wang Yan, an expert in foreign-related legal consulting of WK Group, made a speech titled ‘WK Helping Universities Cultivate Foreign-Related Rule of Law Talents’, explaining the assistance that WK Priority Legal Information Database and WK Priority International Database can provide for the cultivation of foreign-related rule of law talents from the perspective of the construction of China's foreign-related rule of law, and the exploration of the rule of law in colleges and universities in terms of the real needs and practices.

Many professors from the School of Foreign Languages of Nanjing Normal University, based on their dual academic backgrounds in law and foreign languages, discussed in depth the relationship between language skills and legal qualities required for foreign-related rule of law talents, especially under the requirements of the Belt and Road Strategy, illuminated the current situation, and put forward targeted countermeasures.

In addition, Mr Zhang Qiaoling, Vice President of Free Trade Zone Court of Nanjing Jiangbei New District People's Court, Mr Wang Yang, Minister of the Legal Department of Jiangsu Council for the Promotion of International Trade, Mr Li Tingting, Director of Cross-border Investment Co-operation Committee of Nanjing Lawyers' Association, Mr Zhang Jia, Professor of Shanghai University Law School, Professor of Law of Shanghai University, Mr Wang Shengmin of the Department of Law of Nanjing University of Aeronautics and Astronautics, Associate Professor Lock Futao, Assistant Dean of the Intellectual Property College of Nanjing University of Science and Technology/Jiangsu International Intellectual Property College. Associate Professor Liao Futao, Assistant Dean of Nanjing University of Science and Technology/Jiangsu International Intellectual Property Institute, Associate Professor Cai Yangjun and Lecturer Chen Jie, Associate Dean of School of Law of Nanjing University of Finance and Economics, and Zhu Rongqian, Regional Manager of Jiangsu Province of Wolters Kluwer Group, were also present at the meeting.

Finally, in the warm and fruitful communication atmosphere of the experts and scholars, the meeting was successfully concluded.
